Mail Voting Rules Unchanged for Now

Mail voting procedures have not changed yet following a recent U.S. Supreme Court decision involving President Donald Trump’s proposed restrictions.

The Court did not determine whether the president’s order is legal. Instead, it ruled that the states’ initial challenge came too early, restarting the legal dispute shortly before ballots are scheduled to be mailed to some military and overseas voters.

A separate court order currently prevents the U.S. Postal Service from implementing related changes. If that order is lifted, proposed requirements could affect ballot-envelope formatting and how states identify mail voters to the Postal Service. Election officials say making those changes before November would be extremely difficult.

Additional lawsuits are expected. For now, members should understand that no voting procedures have changed, but the situation remains unsettled as the November midterms approach.
